1. Introduction

Welcome to OneIoT ("Platform"), operated by Firewires OneIoT Pvt Ltd ("Company", "we", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Platform. By accessing or using the Platform, you agree to comply with these Terms. If you disagree with any part of these Terms, please do not use our Platform.

2. Definitions

  • Platform: Refers to the IoT services and software provided by OneIoT, including web applications, APIs, and any related resources.
  • User: Any individual, organization, or entity accessing or using the Platform.
  • Account: A registered profile that grants Users access to the Platform.
  • User Data: Any data generated by or transmitted to the Platform by Users, including IoT device data, usage logs, and any personally identifiable information (PII).

3. Account Registration and Responsibilities

  • Users must provide accurate and complete information during registration. Any updates to contact details, such as email addresses or phone numbers, must be promptly reported.
  • Users agree to maintain the confidentiality of their account credentials and are responsible for all activities conducted through their account.
  • The Company reserves the right to suspend or terminate accounts if there is suspicion of account misuse, fraud, or violation of these Terms.

4. Platform Usage

  • Permitted Use: Users may use the Platform solely for monitoring, analyzing, and managing IoT devices in compliance with these Terms.
  • Prohibited Activities:
    • Reverse engineering, decompiling, or attempting to discover the source code of the Platform.
    • Transmitting any viruses, malware, or harmful code.
    • Accessing Platform resources without authorization.
    • Engaging in any activity that interferes with or disrupts Platform functionality.
  • The Company reserves the right to investigate any misuse of the Platform and pursue legal action if necessary.

5. Data Ownership and Privacy

  • User Data Ownership: Users retain ownership of any data transmitted to or generated within the Platform.
  • Data Processing and Security:
    • The Company will process User Data in accordance with the OneIoT Privacy Policy and all applicable privacy laws.
    • User Data may be stored, processed, and analyzed solely for the purpose of delivering the services provided by the Platform.
    • The Company implements security measures to protect User Data; however, Users acknowledge that no transmission over the internet is entirely secure.
  • Consent: By using the Platform, Users consent to the collection, storage, and processing of their data as outlined in the Privacy Policy.

6. Intellectual Property

  • Platform Ownership: The Platform, including its software, design, and all associated documentation, is the exclusive property of Firewires OneIoT Pvt Ltd and is protected by applicable intellectual property laws.
  • Limited License: The Company grants Users a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms. Users must not attempt to sub-license, sell, or distribute Platform resources without prior written consent from the Company.

7. Service Availability and Maintenance

  • Availability: The Company strives to provide continuous access to the Platform but does not guarantee uninterrupted availability. Scheduled maintenance, upgrades, and unforeseen issues may lead to temporary downtime.
  • Notifications: Users will be notified in advance of planned maintenance that may affect Platform availability.
  • Liability: The Company shall not be liable for any loss or damage resulting from interruptions in service.

8. Limitation of Liability

  • Indirect Damages: Under no circumstances shall the Company be liable for indirect, incidental, or consequential damages arising from or related to the use of the Platform.
  • Total Liability: The Company’s total liability to the User, for any claim related to the Platform, shall not exceed the amount paid by the User to the Company for accessing the Platform, if applicable.

9. Indemnification

Users agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to the User’s use of the Platform or violation of these Terms.

10. Modifications to Terms

  • The Company reserves the right to modify or update these Terms at any time. When changes are made, the Company will update the "Effective Date" and provide notice of significant updates.
  • Continued use of the Platform after changes to the Terms constitutes acceptance of the modified Terms.

11. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction].
